In the
name of God Amen. I William Fremlin of Trottiscliffe in the County
of Kent Tanner being at this time in good health of body and of
sound and disposing mind memory and understanding praised to god
for the same. But calling to mind the certainty of death and the
uncertainty of the time when do therefore make and ordain this
my last will and testament in manner and form following. That
is ??? trust and principal I assign my soul the hands of almighty
God who gave it me hoping for remission of all my sins through
the messiahs death and passion of my blessed lord and saviour
Christ Jesus and my body I commit to the Earth to be decently
interred at the discretion of my executrix hereinafter named and
as to such temperall estate as it shall please God in his mercy
to bless me with at the time of my decease I give and dispose
thereof as follows. That is to say I give and devise unto my loving
Mother Ann Fremlin widow all that
my one undivided third part of and the several messuages or tenements
farms lands ?eroditaments premises situate lying and being in
the parish of Kemsing in the said County and all other my real
estate whatsoever and wheresoever with their and every of their
rights members and apportenances To hold to my said Mother Ann
Fremlin her heirs and assigns for ever. In trust that my said
mother Ann Fremlin do and shall as soon as may be after my decease
sell and convey away the same and every or any part or parts to
such purchaser or purchasers and for such sum and sums of money
as she my said trustees shall happen to get for the same and with
the money thereby arising after deducting all such cost charges
and expenses as she shall from time to time sustain or be paid
made or expend in or about the execution of the trust hereby in
her reposed. In the first place I do hereby direct my said trustees
to pay and satisfy all such sum and sums of money as shall be
due and owing by me for principal interest or mortgage and also
the principal sum of fifty pounds now due and owing from me on
bond to Mrs Sarah Allen of Sevenoaks in the said county widow
together with all interest as shall be due and owing thereon in
which bond my said Mother and my sister Ann
Fremlin is become jointly bound with me. And what surplus
moneys shall be remaining in the hands of my said trustees I do
hereby direct my said trustee to place out at interest on government
or other good security and the interest or produce arising therefrom
to be by my said trustee paid and applied towards the maintenance
of my dear and loving wife Eleanor Fremlin and all and every the
child or children by me lawfully begotten or to be begotten on
the body of my said wife for and during the term of her natural
life. In case my said wife shall continue a widow and unmarried
and from and immediately after the death or marriage of my said
wife which shall first happen then I give such interest or produce
to and for the maintenance of such child or children until he
she or they shall attain their respective age or ages of twenty
four years to whom I then give such surplus money equally to be
divided between if more than one. And in case I shall have no
child live to attain the age of twenty four years and my said
wife shall be then dead or married then I give the interest and
produce of such surplus money unto my loving sister Ann Fremlin
spinster for and during the term of her natural life. In case
she shall continue herself single and unmarried and in such case
from and immediately after the death or marriage of my said sister
which shall first happen I give such surplus money unto and amongst
all and every the children of my brother James
Fremlin equally between them. And I do hereby direct and order
that any purchaser or purchasers that my said trustee shall sell
and convey my said real estate or part thereof shall not be concerned
to see their purchase money paid or applied to the trust of this
my will or any of them but that the receipt or receipts of my
said trustee shall essentially discharge the purchaser or purchasers
of the said premises or any part thereof for such sum or sums
as my said trustee shall sign receipts for and after such receipt
or receipts such purchaser or purchasers shall not be answerable
for any debts or misapplication of the said purchase money or
any part thereof. Also all my household goods, bedding, furniture,
plate, linen, ready money, book debts, bonds and other securities
for money, all other of my personal estate whatsoever I give to
my said loving wife for the maintenance of herself and the children
by me begotten or to be begotten on her body and I do hereby constitute
and appoint my said wife to be the executrix of this my will hereby
revoking all my former wills by me at any time before made and
do declare this only to be my last will. In witness whereof I
the said William Fremlin the testator have to this my last will
contained in two sheets of paper set my hand and seal to each
sheet thereof this third day of March in the eighteenth year of
the reign of our sovereign Lord George the second by the grace
of God of Great Britain, France and Ireland King defender of the
faith and so forth and in the year of our Lord one thousand seven
hundred and forty four. |
